By accessing and using GameCaster ("the Service"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.

2. Description of Service

GameCaster is an AI-powered key art studio that enables users to create, edit, and manage game assets and promotional materials. The Service includes asset library management, AI-powered image generation, style studio features, and canvas editing tools.

3. User Accounts

To use GameCaster, you must create an account using Firebase Authentication. You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized use of your account

4. User Content and Intellectual Property

You retain all rights to the content you upload to GameCaster. By uploading content, you grant GameCaster a non-exclusive, worldwide, royalty-free license to use, store, and process your content solely for the purpose of providing the Service.

Content generated using our AI tools is yours to use, but you acknowledge that AI-generated content may not be eligible for copyright protection in all jurisdictions.

User Responsibility for Generated Content: You are solely responsible for ensuring that any content you generate, create, or produce using GameCaster does not infringe upon the intellectual property rights, copyrights, trademarks, or other proprietary rights of any third party. This includes but is not limited to:

• Ensuring that prompts and instructions provided to AI generation tools do not request copyrighted or trademarked content
• Verifying that generated content does not substantially resemble existing copyrighted works
• Obtaining necessary permissions or licenses for any reference materials used
• Conducting appropriate due diligence before commercial use of generated content

GameCaster Disclaimer: GameCaster provides tools for content creation but does not review, monitor, or validate the intellectual property status of generated content. GameCaster bears no responsibility or liability for any intellectual property infringement, copyright violation, or other legal issues arising from content you generate, create, or use through the Service. You agree to indemnify and hold GameCaster harmless from any claims, damages, or expenses arising from your use of generated content.

5. Prohibited Uses

You agree not to use the Service to:

• Upload, post, or transmit any content that is illegal, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable
• Violate any intellectual property rights of others
• Attempt to gain unauthorized access to any portion of the Service
• Interfere with or disrupt the Service or servers connected to the Service
• Use the Service for any commercial purposes without our express written consent

6. AI-Generated Content

GameCaster uses artificial intelligence to generate images and content. While we strive for accuracy and quality, we cannot guarantee that AI-generated content will be error-free, appropriate, or suitable for your intended purpose. You are responsible for reviewing and verifying all AI-generated content before use.

7. Privacy and Data Protection

We collect and process personal data in accordance with our Privacy Policy. By using GameCaster, you consent to the collection and use of information as described in our Privacy Policy. Your data is stored securely using Firebase and Google Cloud services.

8. Service Availability

We strive to provide uninterrupted access to GameCaster, but we do not guarantee that the Service will be available at all times. We reserve the right to modify, suspend, or discontinue the Service at any time without prior notice.

9. Limitation of Liability

GameCaster is provided "as is" without warranties of any kind, either express or implied. In no event shall GameCaster be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service.

10. Termination

We reserve the right to terminate or suspend your account and access to the Service at any time, without prior notice or liability, for any reason, including but not limited to a breach of these Terms.

11. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of any material changes by updating the "Last Updated" date at the top of this page. Your continued use of the Service after such modifications constitutes your acceptance of the updated Terms.
